Roe v Wade to be Overturned Per Supreme Court Leak

The Supreme Court has voted to strike down Roe v. Wade, according to a leak of the initial draft majority opinion written by Justice Samuel Alito. It was published by Politico on Monday night. The word of Roe’s overturn shook the political world, and it means the right to abortion would no longer be determined by the US Supreme Court’s decisions, but by individual states.

Justice Alito’s 98-page draft opinion is dated Feb. 10, 2022. He is joined by Justices Thomas, Gorsuch, Kavanaugh and Coney Barrett. 

The opinion is a draft and not final; it wouldn’t have been issued until the end of the Supreme Court’s session in June, except for this leak. It is being called the greatest security breach in the Court’s history, and the greatest crisis faced by Chief Justice Roberts.

Alabama’s Republican Governor Kay Ivey summed the ruling and the breach this way: “This unprecedented leak is concerning, outrageous and a blatant attempt to manipulate the sacred procedures of the U.S. Supreme Court. Those responsible should be held accountable. My prayer is that Roe v. Wade is overturned and that life prevails.”

Justice Alito’s draft represents the majority opinion. Here are two excerpts:

• “The inescapable conclusion is that a right to abortion is not deeply rooted in the Nation’s history and traditions. On the contrary, an unbroken tradition of prohibiting abortion on pain of criminal punishment persisted from the earliest days of the common law until 1973.”
• “We do not pretend to know how our political system or society will respond to today’s decision overruling Roe and Casey. And even if we could foresee what will happen, we would have no authority to let that knowledge influence our decision. We can only do our job, which is to interpret the law, apply longstanding principles of stare decisis, and decide this case accordingly. We therefore hold that the Constitution does not confer a right to abortion. Roe and Casey must be overruled, and the authority to regulate abortion must be returned to the people and their elected representatives.” (Emphasis added)

Rules for Thee, Not for Me

Politico made the decision to publish this leak, which arguably works against one of our greatest institutions and serves to stir up problems. The same media outlet wrote 5 months ago on, “Why the threat to Roe may not save Democrats in 2022.” That’s one reason that suggests the leak was given to a favorable media outlet in order to coordinate a political stunt and cause disorder. 

Legal analyst Jonathan Turley writes on Twitter, “This is a relatively small number of individuals with access to these drafts. It is likely that the culprit will be contacted quickly with others by investigators. That will prove a critical moment that could transform an unethical into a criminal act… If the culprit is a lawyer, disbarment would be likely.

The FBI has a history of raiding the homes and offices of political enemiesof the regime—such as the reporter who was given Ashley Biden’s diary and investigative reporter James O’Keefe of Project Veritas. To be fair to the rule of law, will the FBI also raid the house of the Politico reporter who published the Alito opinion?

A Variety of Reactions

Pro-life people of all stripes are celebrating what could be a return to the peoples’ right to life–with the federal government being forced to “back off.” People on the other side have temporarily forgotten about vaccine mandates and transgendered “men” giving birth. They’ve promptly returned to claims about womanhood, women’s rights, and “my body, my choice.” 

Interestingly, the entire progressive left abandoned their SCOTUS nominee, Ketanji Brown Jackson, and her assertion that it takes a biologist to define a woman.

Here are some other reactions:

• Clinton front-man Brian Fallon credits a “brave clerk… taking an unprecedented step to warn the country what’s coming in a last-ditch Hail Mary attempt to see if the public response might cause the Court to reconsider.”
• CA Gov. Gavin Newsom called Alito’s opinion and the vote to overturn “an appalling attack” on abortion rights. Democrats in CA have introduced SB 1142, which invites women to come to California for an abortion–paid for by California taxpayers.

Chief Justice John Roberts says the leak is part of an intimidation campaign from the left to get the Supreme Court to change its potential vote to overturn Roe, and that this will not affect the eventual outcome. “We will not allow this leak to undermine the work of this Court,” he admonished, and promised there would be an investigation. 

CNN is reporting that Chief Justice John Roberts would vote no on overturning Roe, but supports the 15-week abortion ban.

President Joe Biden and other Democrats suggest that they will find a work-around to protect abortion. The President told reporters:

• “I’m not prepared to leave [abortion] to the whims of the public at the moment.”
• He also stated that Roe v. Wade establishes what all “basic, mainstream religions conclude, “that the beginning of human life and being is a question.”
• Biden said that Justice Alito’s draft opinion “questions every decision” in one’s private life.

His office released a statement saying that if the Court does overturn Roe, it will be up to elected officials at all levels of government to protect abortion. He did not condemn the leak.

No, Mr. President. You are wrong. Life begins as God determined, with the first spark of egg and sperm uniting. As such, all life in the womb deserves protection. Why this Matters: This leak shows the pro-abortionists’ desperation. It looks to have been a carefully coordinated act. What else could explain the large “squad” of millennial protesters surrounding the Supreme Court building just after the leak was published Monday night–or these other coincidences?

• The leak took place the same day that Dinesh D’Souza’s “2000 Mules” documentary was released proving the election of 2020 was stolen. 
• Influential Democrats like AOC and Bernie Sanders immediately tweeted that Congress must pass legislation to make Roe v. Wade law, eliminating the Senate filibuster so it can pass with 50 votes. (Sen. Joe Manchin said on Tuesday he will not vote to end the filibuster.)
• It happened on the eve of an important primary in Ohio on Tuesday,between Trump supporter JD Vance and a RINO Republican. Ohio is a critical swing state. So we wonder if this leak is a coincidence, or a coordinated effort to foment fear and distrust, as pro-abortion Democrats try to ignite another “burn it all down” season.
• Another civic uprising is just what the regime needs to impose lockdowns and martial law.

We have a crisis at the border, sky-rocketing gas prices, talk of food scarcity, inflation at a 40-year high, and–since the J6 reaction and the SCOTUS leak–trust in the justice system is at an all-time low. It doesn’t seem as if Democrats are worried about winning another election. Perhaps they really are trying to crash our country so that they can bring in the Great Reset. 

People are leaving Democrat-run cities in droves. Many are moving to red states and into the countryside in order to escape tyrants who impose irrational lockdowns and mask mandates. Let’s remember that there are blessings promised in Scripture to those who live according to God’s rules, and a lack of blessings for those who don’t. We may see a very divided nation in the future as God’s Word bears witness to these truths.

How to Pray: May God strengthen the hand of these justices as they prepare to reverse a great evil. Pray for the five Supreme Court Justices (Alito, Thomas, Gorsuch, Kavanaugh, and Coney Barrett) to stay strong and bring this opinion to repeal Roe v. Wade across the finish line. Praise Him for this opportunity!
