Clinton Lawyer Michael Sussmann: “I am Coming on My Own”

Special Counsel John Durham is a stealthy sleuth. Hired by the Trump administration several years ago, Durham was tasked with investigating the Russia collusion narrative. He has been quietly doing that. Now we have the first indictment, that of Clinton lawyer Michael Sussmann, and an upcoming trial. These are pivotal moments for Clinton’s house of cards. The next play will determine if the narrative can stand. At stake are the futures of Hillary Clinton, the upper echelon in the Obama FBI and Department of Justice, and possibly even President Biden and former President Obama.

The charge seems small: lying to the FBI. Is it enough to start such an avalanche?

Mr. Durham released the first piece of damning evidence though a court filing on Monday. It contains a text message sent by lawyer Michael Sussmann to James Baker, who was the FBI’s general counsel. The September 18, 2016 conversation went like this:

  • “Jim – it’s Michael Sussmann. I have something time-sensitive (and sensitive) I need to discuss. Do you have availability for a short meeting tomorrow?
  • “I’m coming on my own—not on behalf of a client or company—want to help the Bureau. Thanks.”

Baker allegedly replies, ”Ok. I will find a time. What might work for you?”

The two men met, and Sussmann explained his suspicions about a connection between Trump and Russian-based Alfa Bank. Baker listened, then turned the information over to top FBI officials Tricia Anderson and Bill Priestap. He told them that the media would be publishing the story in a few days, showing Trump’s connection to the Russian Kremlin. 

At issue now for the court to decide is this: Did Hillary Clinton’s campaign, her researchers, and others form a “joint venture or conspiracy” to harm Trump’s election chances and his presidency?

Let’s look at the indictment and the evidence, then you can decide if this might be the first step of justice coming for Hillary and her conspirators.

Lying and Spying 

It is clear from the evidence offered by Durham that Sussmann was lying.He was working for the Clinton campaign while at Perkins Coie, the law firm that organized the phony Trump dossier which was created by British spy Christopher Steele. Sussmann’s partner at Perkins Coie was Marc Elias, a long-time Clinton legal henchman. 

We know Sussmann lied because he billed Hillary for the work he did to concoct phony evidence connecting Trump to the Kremlin.

In fact, Perkins Coie repeatedly billed the Clinton campaign for Sussmann’s on-going efforts. Later, he told Congress that he was directed by his client to deliver the phony Russian narrative to the FBI and CIA. And that implicates Hillary.

In his court filing, Durham is asking that Sussmann’s congressional testimony from December 2017 be admitted as evidence. Here is the important part:

  • Sussmann was interviewed under oath by Kash Patel, who was chief congressional investigator for the House Intelligence Committee.
  • Patel asked Sussmann if he engaged with the FBI and the CIA on his “own volition.” 
  • Sussmann replied: “No.” He was directed by his client to talk to the FBI and CIA in February 2017, and disclose additional information.
  • “I think it’s most accurate to say it was done on behalf of my client,” he stated.

Part B of the allegations are that Sussmann was also working for and with tech executive Rodney Joffe. 

According to Durham, in July 2016 Joffe and Sussmann began looking for a link between Trump and Russia on behalf of the Clinton Campaign, using numerous cyber researchers at Georgia Tech and employees at multiple internet companies. Georgia Tech had a contract with the Department of Defense’s Defense Advanced Research Projects Agency (DARPA), the FBI, and cybersecurity experts.

Together, these entities exploited their access to national security data to try and destroy Donald Trump’s chances in order to “please VIPs at the Clinton Campaign” (according to Joffe).

  1. They monitored all of Trump’s internet connections at Trump Tower and his other properties, some of which went to Alfa Bank. 
  2. The spying continued even after his inauguration, when Sussmann also took his false accusations to the CIA.
  3. Trump haters in the government, education, and big tech colluded to invent garbage to destroy Donald Trump.

Media Matters

Sussmann shared an updated version of the Alfa Bank allegations with the CIA on February 9, 2017. The effort was to suggest there was internet traffic at Trump-related locations connecting to the IP addresses of a rare Russian cell phone provider.

Sussmann may have also given that phony information to the Senate Armed Services Committee.

Full Speed Ahead, Despite Concerns

The emails included in Durham’s filing show the researchers’ concerns. Several people working on this scheme were aware of potential problems. They knew the allegations were false but were trying to fake a connection to force an investigation.

One researcher wrote:

  • “It’s not a good case as it stands, but I don’t have the slightest doubt in my mind… that Trump is doing illegal work with Russia.”
  • He admitted there’s no proof of the flow of money from Russia to Trump, 
  • However, he said he could “fill out a fake sales form on two websites causing them to appear to communicate with each other in DNS [Domain Name System] and give it to Joffe who can develop a stronger inference.”

Donald Trump maintained that his only connections with Russia were a failed casino and a beauty pageant. These researchers were looking to create a story to prove Trump was a liar, one they could use as the excuse for a closer examination.

Another Joffe researcher said the entire project is flawed because they can’t defend a faked connection and it would not stand up to public scrutiny. “The only thing that drives us at this point is that we do not like [Trump],” he said.

The October Surprise

What was needed in 2016 was a way to stop people from voting for Trump—a kind of “October Surprise.” Thus was born this pre-election “breaking news” in the mainstream media of Trump Russia collusion. These stories did not come through diligent reporting, but by way of Michael Sussmann.

Again, we look at Perkins Coie billing records from September 12, 2016, when Sussmann spent time trying to talk “Newspaper 1” (as labeled in Durham’s filing) into publishing the Trump-Alfa Bank story.

Sussmann also dutifully billed Clinton for the time it took to notify her campaign about his efforts!

On the same day the story was published, Hillary tweeted: “Computer scientists have apparently uncovered a covert server linking the Trump Organization to a Russian-based bank.” She included a statement from Jake Sullivan, her Senior Policy Advisor (now Biden’s National Security Advisor) saying, “this could be the most direct link yet between Donald Trump and Moscow…”

Her second tweet that day said, “It’s time for Trump to answer serious questions about his ties to Russia,” with a link to a Slate article entitled “Four Things You Need to Know about the Trump Organization’s Secret Server to Communicate with Russian Alfa Bank.”

That story was recycled ad nauseam, until the pubic accepted it as truth.

ALFA BANK Pushes Back

Alfa Bank is now trying to expose these hackers, using the US courts. Alfa Bank says hackers created “a highly sophisticated cyber-attacking scheme to fabricate apparent communications between [Alfa Bank] and the Trump Organization” in the months leading up to the 2016 presidential election. The Court agreed that Rodney Joffe should be deposed. Additionally, Joffe was made to testify to a grand jury in February, after refusing to speak to Durham’s team for more than a year. 

Going Forward

This is where things stand as of Monday, April 4. The US government, under Durham (pictured at left), filed a motion to sort out some things before the trial begins. The two sides are at odds over what is admissible.

Lawyers for Sussmann want the whole thing thrown out because no one at the FBI ever asked Sussmann where the information came from. Additionally, they say it was not a crime to lie because the false statement was obviously not material to the FBI.

  • Sussmann wants to exclude the testimony/evidence from FBI Director Bill Priestap and FBI General Counsel Tricia Anderson, calling their testimony here-say.
  • He wants Rodney Joffe to be given immunity, or have the case dismissed. Sussmann says Joffe would provide testimony that exonerates him, but because Joffe is afraid of being held criminally liable, he is asserting his Fifth Amendment right instead.
  • Sussmann asks that the Steele dossier be kept out of the trial.

Durham, on behalf of the US government, says all of this must be included:

  • Notes written by FBI agents regarding Baker’s conversation with Sussman because Priestap and Anderson write that Sussmann came “on his own” and not on behalf of a client.
  • Emails, like those outlined above
  • Sussmann’s testimony before Congress where he contradicted what he told the FBI, namely that he was working for someone. 
  • Hillary’s tweet October 31, 2016 (we don’t know which one)

Why this Matters: Durham suggested in his filing that Hillary Clinton’s campaign, her researchers, and others formed a “joint venture or conspiracy” for the purpose of weaving the collusion story to harm Trump’s election chances and then the start of his presidency.

“These parties acted as ‘joint venturer[s]’ and therefore should be ‘considered as co-conspirator[s],’” he wrote.

Additionally, Durham states “that in November 2016, soon after the Presidential election, Tech Executive-1 [Joffe] emailed a colleague, stating, “I was tentatively offered the top [cybersecurity] job by the Democrats when it looked like they’d win.'” 

“In sum, the above evidence, public information, and expected testimony clearly establishes by a preponderance of the evidence that the defendant and Tech Executive-1 worked in concert with each other and with agents of the Clinton Campaign to research and disseminate the Russian Bank-1 allegations.”

The trial is scheduled to being May 16.

When Hillary and others conspired to frame Donald Trump and his team, they sealed their own fate. The Bible tells us that what was meant for evil, God can use for good, and according to Romans 2:1-2, the perpetrators have already been condemned by their own actions.

How to Pray: Let’s keep in mind that God often allows the enemy to stir up lies and cause battles in order to further His purposes. Perhaps this was allowed to drag out so long to set the stage for a divine intervention through the US legal system. Pray for God’s will. Pray for the truth. Pray for judgment–and that we would not rejoice in their downfall, but only that God and His justice prevail.

Romans 2:1-2 – Therefore thou art inexcusable, O man, whosoever thou art that judges: for wherein thou judges another, thou condemn thyself; for thou that judges does the same things. But we are sure that the judgment of God is according to truth against them which commit such things.
