New Allegation, New Road to Impeachment?

Acting DNI Joseph Maguire testifies before House Intelligence Committee 9/26

On Thursday, the Intelligence House Committee heard testimony from Acting Director of National Intelligence, Joseph Maguire regarding an allegation that President Trump is attempting to sway the upcoming presidential election. The Democrats are calling it a coverup and this is another arrow in their impeachment quiver. The “whistleblower,” a CIA employee assigned to work at the White House, lodged a complaint based not on what he personally witnessed, but on what anonymous sources told him plus media reports.

The Phone Call

President Trump called Ukrainian President Zelensky, who had just won the election, on July 25 to congratulate him. During the conversation, Trump brought up the matter of Joe Biden and his son, Hunter, who was caught in a corruption probe because of his connections to a Ukrainian natural gas company called Burisma.

Not discussed in the call, but essential to understanding the backstory, are these details:

  • Hunter was being paid $50,000+ per month as a board member of Burisma, even though he has no background in the natural gas industry or qualifying experience.
  • Biden’s firm, Rosemont Seneca Partners, received regular transfers into one of its accounts from Burisma, totaling $166,000 a month.
  • Joe Biden, who was US Vice President at the time, threatened then-President Poroshenko with pulling $1 billion in US loan guarantees if he didn’t fire the prosecutor.

Pres. Trump holds joint press conference with Pres. Zelensky of Ukraine, alluding to Hillary’s missing 33,000 emails and disclosing that the whistleblower’s lead attorney is a Biden supporter and donated to his campaign. Later, Trump identified what he believes is the heart of the matter, that a “CIA” employee was placed at the White House to spy on him.

In the call, President Trump stated:

“I would like to ask you to do us a favor, though, because our country has been through a lot and Ukraine knows a lot about it. I would like you to find out what happened with this whole situation with Ukraine, they say CrowdStrike. … I guess you have one of your wealthy people … the server, they say Ukraine has it..I would like to have the attorney general call you or your people and I would like you to get to the bottom of it…”*

“The other thing, there’s a lot of talk about Biden’s son, that Biden stopped the prosecution and a lot of people want to find out about that so whatever you can do with the Attorney General would be great. Biden went around bragging that he stopped the prosecution so if you can look into it… It sounds horrible to me.”

*The official document states “This is not a verbatim transcript, but the notes and recollections of Situation Room Duty Officers and NSC policy staff assigned to listen and memorialize the conversation in written form as the conversation takes place.”

The call was recorded and transcribed. A CIA employee went to the Inspector General of the Intelligence Community with what he called an “urgent matter.” He says he was informed by more than half a dozen US officials that the President is using the power of his office to solicit interference from a foreign country in the 2020 elections by asking them to investigate his rivals.

The whistleblower also cites “fact patterns” as substantiation, even though these are simply media reports containing false information, such as saying Trump mentioned Biden 8 times. Biden was mentioned once. But since the whistleblower didn’t hear the conversation, he was relying on hearsay.

The transcript and the whistleblower’s allegations don’t completely match:

1. Trump pressured the Ukrainian President.

  • President Zelensky said on camera during a press conference he was not pressured and it was a good phone call; normal. “We spoke about many things. I think, and you read it, that nobody pushed me.”

2. Trump asked for the DNC servers to be turned over.

  • President Trump said, “I would like you to find out what happened with this whole situation with Ukraine, they say CrowdStrike… I guess you have one of your wealthy people… The server, they say Ukraine has it.”

3. Trump threatened to pull military aid if they didn’t investigate Biden.

  • At the beginning of the call, President Trump said the US has done a lot to help Ukraine, and he thought European countries should do more. Democrats say this was a veiled threat.

4. The White House demanded the call records be “locked down” and loaded onto a separate system normally used to store sensitive data, saying this was an act of abuse.

  • The transcripts of calls with leaders from Mexico and Australia early in Trump’s presidency were leaked to the media. All of the president’s phone calls are privileged and should be protected from leakers.

Department of Justice Reaction

The DOJ/FBI considered if the President’s words, “Do us a favor” amounted to a violation of campaign finance laws. They found that this wasn’t a “thing of value” so an investigation wasn’t opened. The information wasn’t turned over to Congress, and the Democrats are furious, saying this is the first intelligence community whistleblower complaint that has ever been withheld from them.

Former acting director Matt Whitaker defended the dismissal, saying, “Not only did I not see anything that was illegal, but the Department of Justice looked at this issue about this phone call and determined there was nothing that was illegal about this conversation and it’s not even close.”

CrowdStrike

Mr. Trump referenced CrowdStrike, suggesting they have DNC server/s in Ukraine. CrowdStrike is the cybersecurity firm hired by the Democrat National Committee to investigate the “hack” of their servers in 2016—rather than having the FBI or Department of Homeland Security look into it.

  • CrowdStrike claimed the Russians did it, and Robert Mueller brought charges against two hacking groups. This is despite the fact that the information was too big to be transmitted over the internet, but had to have been stolen via thumb drive or other device.
  • The “hacked” server/s have never been provided to the FBI or any other intelligence agency.
  • WikiLeaks published the stolen DNC emails, and publisher Julian Assange said it was not a state actor that provided the material.
  • Former DNC employee Seth Rich, a Bernie supporter, may have taken the data hoping to expose unfair treatment. Rich was attacked several days later in what was said to be a robbery—although nothing was stolen. Rich was transported to the hospital in an ambulance, talking and in stable condition, but died that night.

Hypocrisy on Parade

What President Trump did not mention, but seem particularly pertinent, are the following elements reveal stunning hypocrisy.

  • Sen. Chris Murphy (D-CT) visited Zelensky earlier this year and, by his own account, said Zelensky could jeopardize US support if he investigated past corruption allegations against Biden. He told the president that US aid was Ukraine’s “most important asset” and it would be disastrous for long-term relations if he investigated.
  • In May 2018, three Democratic U.S. Senators, Bob Menendez, Dick Durbin, and Patrick Leahy, sent a letter to Yuriy Lutsenko, the Ukrainian general prosecutor. In it, they asked why he had not cooperated with the Mueller investigation, and hinted that was because the Trump administration told them not to. They wanted to know if the probe was discussed with US officials when former President Poroshenko and Trump met in 2017.
  • Rep. Adam Schiff opened Thursday’s hearing by doing a mock conversation between Presidents Trump and Zelensky. He spoke as though Trump was a mob boss and made up facts as he went along. When called on it, Schiff said it was just a parody.

The End of the Matter is Coming

A team led by U.S. Attorney John Durham is investigating Ukraine’s role in potential 2016 election interference—specifically exploring the extent to which a number of countries, including Ukraine, played a role in the plot against the Trump campaign during the 2016 election. Ukrainians who are not government officials have volunteered information as part of the probe.

The investigation may uncover that the DNC server/s are in Ukraine, and they may contain Hillary’s missing 33,000 emails as President Trump suggested.

There are several tranches of documents that the President has declassified, but have not been released yet, pertaining to the Russia-collusion probe, the abuse of surveillance on Trump and his associates, plus investigations by the Inspectors General and the Special Prosecutor, John Huber. President Trump has the authority to release them at any time, presumably just the right time to cause the greatest political harm to the Democrats.

In the meantime, House Democrats continue to build their case for impeachment without any actionable facts. Impeachment is unlikely. It requires a vote of 2/3 of the Senate, which is held in the majority by Republicans. However, the constant attacks serve to convince a gullible public that Trump is corrupt and needs to go.

Why this Matters: A message from God in Romans 2:1 tells us that false accusers accuse you of what they themselves are doing. Although the President knew what he was getting into by taking this job, did he expect it would be this difficult? Did he understand how hard the swamp would fight back?

An interesting statement was released today regarding new sanctions against Iran. Perhaps it contains communication to an audience closer to home. Secretary Pompeo said that senior Iranian officials will now be barred from entering the US:

“No longer will elites reap the benefits of a free society while the Iranian people suffer under the regime’s corruption and mismanagement.”

Are they putting the Deep State on notice?

We long for the day when the elites in Washington are barred from reaping the benefits of a free society in which hardworking Americans suffer under their corruption, mismanagement, and worse.

Pray for God to mete out justice quickly and completely. Pray that those who have a heart to repent will turn to Him and receive forgiveness. Pray for our nation to turn from wickedness.

Rev. 3:7-11 – I know thy works: behold, I have set before thee an open door, and no man can shut it: for thou hast a little strength, and hast kept my word, and hast not denied my name. Behold, I will make them of the synagogue of Satan, which say they are Jews, and are not, but do lie; behold, I will make them to come and worship before thy feet, and to know that I have loved thee. Because thou hast kept the word of my patience, I also will keep thee from the hour of temptation, which shall come upon all the world, to try them that dwell upon the earth. Behold, I come quickly: hold that fast which thou hast, that no man take thy crown.
